    Current Rules and Regulations

    Below are the CURRENT Rules and Regulations.

    Rules & Regulations For Carter Ranch Homeowners Association

    Adopted February 6th, 2007

    These Rules are supplemental to all of the Covenants, Conditions,
    restriction and provisions of the Declaration and are subject to change at
    the discretion of the Board of Directors. In the event of any conflict
    between the Rules and the Declaration or Bylaws, the Declaration or Bylaw
    shall control.

    3.5 Antennas

    Except as permitted under the Design Guidelines, no antenna, aerial,
    satellite television dish or other device for the transmission or reception
    of television or radio signals or any other form of electromagnetic
    radiation proposed to be erected, used or maintained outdoors on any
    portion of the Project, whether attached to a Residential Unit or structure
    or otherwise, shall be erected or installed without prior written consent of
    the Architectural Review Committee. Once approved:


    > The antenna must be placed on the Lot in such a manner as to not
    be visible from any other Lot, the Common Area or any street
    unless it is impossible to do so without impairing the user's ability
    to receive signals from a provider of DBS, MMDS, or TVBS.

    > If the antenna is mounted on a residence or other structure and is
    visible from any other Lot, the Common Area or any street, the
    antenna must be painted a color which will blend into the
    background against which the antenna, unless the painting of the
    antenna would impair the user's ability to receive signals from a
    provider of DBS, MMDS, or TVBS. Mounting material, accessories,
    and cabling shall be painted so as to blend with the background
    against which it is mounted.



    3.12 Animals

    No animal, bird, fowl, poultry, reptile or livestock may be kept on any Lot,
    except a reasonable number of generally recognized house or yard pet
    ("Permitted Pets") may be kept on a lot if they are kept, bred or raised
    thereon solely as domestic pets and not for commercial purposes. All
    Permitted Pets shall be confined to an Owner's Lot except that a dog may
    be permitted to leave the Owner's Lot is such dog is at all times kept on a
    leash not to exceed six (6') feet in length and is not permitted to enter
    upon any other Lot. No Permitted Pet shall be allowed to make an
    unreasonable amount of noise or to become a nuisance.

    > General house pets shall mean dogs, cats, birds, and fish.

    > Owners must have proper cleaning equipment when walking their
    pets.

    > When walking dogs, they must be kept on a leash at all times.

    > According to City Ordinance there can only be four (4) pets per
    household.


    3.7 Trash Containers and Collection

    No garbage, trash, or debris shall be allowed, stored or placed on a lot
    except in sanitary, covered containers of a type, size and style which are
    approved by the Architectural Review Committee. In no even shall such
    containers be maintained so as to be visible from Neighboring Property
    except to make the same available for collection and then only for the
    shortest time reasonably necessary to effect such collection. All rubbish,
    trash, or garbage shall be removed from Lots and other property and
    shall not be allowed to accumulate thereon. The Board shall have the
    right to adopt rules and regulations regarding garbage, trash, trash
    containers and collection.

    > Trash cans shall not be out before 6:00 p.m. the night before
    collections.

    > Trash cans must be removed from the Street and out of view from
    neighboring properties by 1 0:00 pm the day of collection.

    3.16 Parking

    No truck, mobile home, travel trailer, tent trailer, trailer, camper shell,
    detached camper, recreational vehicle, boat, boat trailer, automobile or
    other similar equipment or vehicle may be parked or maintained,
    constructed, reconstructed or repaired on any Lot or Common Area so as
    to be visible from Neighboring Property, except for the temporary
    parking of a motor home, camper, recreational vehicle or boat and boat
    trailer on the concrete driveway situated on a Lot for a period of not more
    than seventy—two (72) hours within any consecutive seven (7) day period
    for the purpose of loading or unloading such vehicle or equipment. Boats
    and motor vehicles can be parked in garages on Lots so long as such
    vehicles are in good operating condition and appearance and are not
    under repair or motor vehicles not exceeding seven (7) feet in height and
    twenty—two (22) feet in length and which are parked in the garage or on
    the concrete driveway situated on a Lot, provided that such vehicles shall
    not be parked in a manner as to block the sidewalks or impede
    pedestrian traffic in any way. Motor vehicles of Residents of Guests of a
    Resident parked within the Project shall be parked in the garage or on the
    concrete driveway of such Resident's Lot at all times when sufficient
    parking areas exist in the garage or on the concrete driveway. Parking on
    unpaved portions of Lots is prohibited.

    3.19 Garages & Driveways

    Garages situated on Lots shall be used only for the parking of vehicles
    and shall not be used or converted for living or recreational activities
    without the prior written approval of the Architectural Review Committee.
    Garages may be used for the storage of material so long as the storage of
    material allows sufficient space for the parking of at least one (1) motor
    vehicle.


    3.22 Basketball Goals and Backboards

    No basketball hoop, goal or backboard, whether permanent or portable,
    shall be constructed or installed on any Lot without the prior written
    approval of the Architectural Review Committee.

    > Portable basketball hoops are permitted with these guidelines

    > Portable or temporary goals are acceptable: they may be placed
    in your driveway and cannot impede sidewalks or other traffic.

    > Portable goals must be removed from visibility after play has
    ceased. A goal may not remain out overnight.

    > All portable hoops must always be well maintained.

    > Portable basketball goals or backboards are only allowed to be
    used between the hours of 9:00 am and 10:00 pm.


    Flags

    Flags must be attached to the main structure of each Lot with a pole
    (mast) of no longer than six (6) feet in length.


    Water Hoses

    Water hoses that are visible from neighboring property shall be installed
    upon a water hose reel, mounted to the main structure or mounted on
    wheels. All water hoses shall be stored on its reel when not in use. Hose
    pots area approved, provided the hose is stored when not in use.


    Security Doors

    Security Doors that have been attached to the front door of the main
    structure of each lot shall be kept in proper repair and painted either the
    color of the main structure or black.


    Repainting of Houses and Walls

    Use of the builder's original exterior color options SHALL NOT require
    approval from the Architectural Review Committee. Any other exterior
    color combinations SHALL require prior written approval from the
    Architectural Review Committee.


    Gates

    Staining gates the natural wood color originally installed by the builder
    SHALL NOT require approval of the Architectural Review Committee. All
    changes and modifications to the appearance, color, structure, location
    or placement of an existing gate SHALL require written requests and
    approval of the Architectural Review Committee. New gate installations
    must be substantially the same as those originally installed by the builder
    and SHALL require prior written approval of the Architectural Committee.

    Play Equipment/Swing Sets

    All play equipment that exceeds eight (8') feet from ground level and is
    not placed a minimum of ten (1 0') feet from neighboring boundaries
    SHALL require prior written approval from the Architectural Review
    Committee. The Architectural Review Committee may consider Play
    equipment if it adheres to the following guidelines:

    > Climbing platforms and slides shall be placed not higher than two
    (2') feet below the highest point of the rear yard fence to protect
    the privacy of neighboring owners.

    > Play equipment exceeding the height of six (6') feet and or not
    placed a minimum of five (5') feet from all neighboring boundaries
    shall be screened from adjoining properties and/or common area
    (including streets) by shrubs or trees which will equal the height of
    the play equipment within a reasonable time period. The
    Architectural Committee may require that the equipment be
    painted a color compatible with the house on the Lot.

    > Brightly colored canopies, roofs, or other visual distractions that
    are attached to the Play Equipment SHALL NOT be visible from
    neighboring property or common area (including streets).

    > No lights or nighttime illumination of the Play Equipment shall be
    allowed, except ground mounted low—voltage lighting not visible
    from neighboring properties or common area (including streets).



    Storage Sheds

    Storage sheds kept below the height of the privacy or perimeter wall
    SHALL NOT require approval from the Architectural Review Committee.
    Any storage sheds that would be visible from neighboring property or
    common area (including streets) SHALL require approval of the
    Architectural Review Committee. The Architectural Review Committee
    may consider Storage Shed if it adheres to the following guidelines:

    > The Architectural Review Committee may require that the shed be
    painted a color compatible with the house on the Lot.

    > Storage Shed exceeds the height of six (6') feet and or not placed a
    minimum of five (5') feet from all neighboring boundaries shall be
    screened from adjoining properties and/or common area (including
    streets) by shrubs or trees which will equal the height of the
    storage shed within a reasonable time period.


    Pools & Spas

    Pools and spas SHALL NOT require the pre—approval of the Architectural
    Review Committee. Access to rear yards for construction shall be gained
    by removing a front wall adjacent to the house. Removal of a common
    wall (opening on side or back yard) SHALL require written requests and
    approval by the Architectural Review Committee. All walls must be
    restored to their original state at the owner's expense as soon as
    possible. The homeowner is also responsible for the cost of repair or
    replacement to any damaged landscaping on common property.
    Reasonable care for the safety of others must be given by the homeowner
    and the pool company while the wall is down.

    > Pool slides or aboveground pools visible from neighboring property
    or common area (including streets) SHALL require written requests
    and approval from the Architectural Review Committee.
    Consideration will be given to the proximity of the adjacent
    neighbors

    > Backwashing (or draining) pools and spas onto common areas or
    streets is prohibited at all times.

    At the July 26, 2016 Carter Ranch HOA meeting, the board INFORMED us of the following change to the Rules and Regulations. They didn't ask for our input or opinions, just that the few of there should vote on it. When they asked for a vote from those present, I inquired if it was legal for them to change Rules and Regulations without notifying the homeowners, they said they had the power to do it and that if the homeowners wanted to voice an opinion "They could have come to the meeting". Not sure about the rest of you homeowners but I personally think that if the board is determined to have critical changes that should be brought before the homeowners for vote, the homeowners should be informed of such changes with ample time before the meeting to decide if they want to be there or not. Simply putting an A-frame sign at the entrance to the subdivision alerting 2-3 days ahead of time that a meeting will take place is insufficient. I have gone to these meetings on and off since the HOA was formed and they are normally mundane and this is the first time in 11 years that a change to the Rules and regulations has ever occurred. The board has assumed too much power in the last year or so since they have come under the advisement of Snow Property Services. If you ask the board why you were not informed, you will most likely hear that it costs too much. Yes, it does cost about $150 to send out a letter BUT the Board said that they were going to send out quarterly newsletters and a change such as this could have been listed in said newsletter if they actually did what they said. Had it been in the newsletter, it would have given all of us the choice to come to the meeting or not based on the interest in the change in rules. Furthermore, they stated in the meeting that several more unilateral changes were in the works.

    WE have lost control of our board of directors. They now control us. This may seem like a minor change but it is simply a harbinger of things to come. Remember, there is no such thing as a little bit pregnant.

    3.22 Basketball Goals and Backboards

    Portable Basketball Hoops are permitted with these guidelines

    Portable or temporary goals are acceptable; they may be placed in your driveway and cannot impede sidewalks or other traffic.
    (ADD) {A goal may not remain overnight.}

    (Delete) [Portable goals must be removed from visibility after play has ceased. A goal may not remain overnight.]
    {Replace with} {When play has ceased, portable goals shall be removed and stored out of sight where practical or laid horizontally in the side yard.}

    All portable hoops must always be well maintained.

    Portable basketball hoops or backboards are only allowed to be used between the hours of 9:00 am and 10:00 pm.

      Well, this is posted on the HOA website, such as it is:



      Carter Ranch Homeowners Association

      The board of directors is in the process of reviewing and updating the Rules and Regulations of the community. There has been an approved change to the ruling of the storage for basketball hoops. If you have a basketball hoop in front of your home, you are no longer required to store behind the gate when not in use. You may leave on side of home if it is lying down.

      Once the Board has completed their review of the Rules and Regulations they will present and discuss in an open meeting prior to making any changes. After that process is completed the updated version of the Rules and Regulations will be distributed.

      However, as you can see in the first paragraph, they made a change to the Rules and Regulations about the basketball hoops and, as one who has not missed a meeting in a couple years, THIS WAS NEVER BROUGHT UP IN OPEN MEETING FOR DISCUSSION. Only thing in open meeting was to inform the residents that they had run amuck and made changes. If you listen to that meeting, you will also hear the snide remarks about "If homeowners want to know what is going on, they can come to the meetings. Maybe in their ignorance, they don't understand that 1/3 of the homeowners are non-residents of the subdivision. Some live in other states, some live in other countries. All non-residents have no clue when meetings are taking place as the only notice is an A-Frame at the entrance to the sub. I guess the Canadians need a telescope to read it. Wake up neighbors.

      Had the basketball hoop item been brought up in open meeting, we would have been able to enlighten the board as to why the original rule was written as it was. When the hoop is along side the house, the children will play with it there and the ball will bounce off of the house, MY HOUSE. After time, it will damage the stucco.
