Now I have seen everything. At the Annual meeting, the homeowners showed their angst with the board of directors and the ballot by not even 26 homeowners returning the ballot. The feeling is "why bother?". There are three open seats and only two choices and no place to put in a write in candidate. The reason there is no spot for write in is that they want to control the board. Look at the paragraph above the line. If you want to run, send them a short bio and "they (the Board of Directors) will be appointing the last open position." I don't know about the rest of you but I for one would really like to see a FULL AUDIT. When there is so much money in the bank and the board is controlling who is on it and picking the members rather than allowing the homeowners to vote, I am suspicious.

So, investigating the governing documents on the official CRHOA website maintained by Snow Property Services and condoned by the Carter Ranch HOA Board of Directors, this is the only reference to the legality of defining a quorum:
2.4 Quorum. Except as otherwise provided in the Articles, the Declaration or these
Bylaws, the presence in person or by proxy of Members entitled to cast one-tenth (1/10th) of the
total authorized votes in the Association shall constitute a quorum at all meetings of the
Members. If a quorum shall not be present at any meeting, the Members entitled to vote thereat
shall have the power to adjourn the meeting from time to time until a quorum shall be present.
This is from the Bylaws as there was no mention in the CCRs. This means 26 votes are necessary and the Board of directors and Snow Property Services has no right to declare otherwise. Here is an excerpt from section 2.8 of the Bylaws as well:
Approval by written ballot pursuant to this Section is valid only if both the number of votes cast by ballot equals or
exceeds the quorum required to be present at a meeting authorizing the action and the number of
approvals equals or exceeds the number of votes which would be required to approve the matter
at a meeting at which the total number of votes cast was the same as the number of votes cast by
ballot.
Again, no mention of any rule or Bylaw or Arizona law allowing the number required for a quorum to be lowered to suit the needs of the Board or Snow Property Services. This should be disturbing to any and all Homeowners in Carter Ranch. The HOA Board is no longer representing the homeowners of Carter Ranch but making rules and Bylaws as they go along to suit their purposes.
